Long <br />Denver, CO 80202-5733 Division Director <br />Re: Foidel Creck Mine {Permit No. C-1982-056) <br />Technical Revision Application No. 41 (TR-41) <br />Revised Design for Batch Loadout Haul Road Batch <br />Dear Mr. Johnston: <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on May 29, 2002, an application to revise coal mining <br />operations at the Foidel Creek Mine was considered complete for the purposes of filing. The revision was <br />submitted by Twentymile Coal Company. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />The operator proposes [o modify the haul road design that [he Division previously approved as technical Revision <br />TR-30. The operator proposes the following two modifications. <br />1. A reduction in the designed top-width of the haul road to 24 feet, 6 feet less than the original design. <br />2. The addition of conventional salvaging and stockpiling of topsoil as another method of topsoil protection, in <br />addition to the previously approved placing of fabric on top of the topsoil and then building the road over <br />the fabric. <br />The construction process will remain as previously approved in TR-30. The purpose of the proposed <br />modifications is to reflect the change in plan to use only 10-ton trucks on the haul road, rather than 100-ton trucks <br />as originally planned. The previously approved wider road design in TR-30 will remain effective, allowing the <br />option to increase road width at a later time. <br />The Undergound coal mining operation is on land located approximately 23 miles Southwest of Steamboat <br />Springs, Colorado. The permit area is further described as follows: <br />In portions of Sections 7, 8, 9, T4W, R86W; Sections 32 and 33, T6N, R86W; Sections 23, 24, 25, 26, 27, 34, 35 <br />and 36 in TSN, R87W; and all of TSN, R86W with the exception of Sections 34, 35, and 36. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Rattlesnake Butte. <br />
