No. 27 <br />Oak Creek, Colorado 80467 <br />RE: Minor Revision 11 - Mine No. 3 - C-84-062 <br />Dear Mr. Middleton: <br />We have received the above-referenced minor revision application, and we have <br />also consulted with Sandy Marek of the Colorado Department of Health to <br />determine which water quality atandarde are applicable in this case. Sandy <br />indicated that the NPDES effluent limitations are not applicable because the <br />reclamation parcel seeded in 1983 cannot be considered a "point source". <br />Therefore, the only applicable atandarde are the stream standards associated <br />with Trout Creek. Additionally, CYCC has agreed to monitor total suspended <br />sediment concentrations in the Homestead Ditch. We believe that this would be <br />a prudent measure, given the scrutiny that the "small-area" exemption has <br />received. Please provide the following information: <br />1. Verification that monitoring stations 301 and 69 are upstream and <br />downstream, respectively, from the location on Trout Creek where the <br />Homestead Ditch tailwater intersects the creek. <br />2. A compilation and analysis of water quality data for the Trout Creek <br />stations, which verifies that the Trout Creek stream standards have not <br />been jeopardized by the parcel. You may use those stream quality <br />standard parameters which are already used in your monitoring plan. <br />3. A detailed plan to monitor sediment concentrations on the Homestead <br />Ditch, including a baseline determination, and an attempt to obtain <br />similar measures during or shortly after a precipitation event. <br />4. A specific timeframe commitment regarding the sediment monitoring if you <br />are unable to obtain water samples due to a lack of flow in the ditch. <br />If the sediment data is not available immediately, then it will be <br />processed by way of another minor revision when available. <br />
