Teller Street, Lakewood, ('olorado 80235, and: US West ROW Department 9750 E. Castilla Enf;lewaod, Colorado 80112 hereinafter referred to as the "Structure Owner". 'llt<: Colorado Mined Land Reclamation Act requires that tando~mers adjacent to a proposed mining operation be informed about the mine and the reclamation. Further, the Act provides protection for structures that are within 200 feet of a mining operation. Aggregate Industries, has submitted an amendment application W tha State of Colorado for its Division of Minerals an•i Geology Regular 112 Operation Permit No. M-1989-029, and an amendment application to USR 877 within Welri County, for sand and gavel mining located at or near Sections 7, 6, 17 and 19, T2N, R68 W of the 6'" P.M., Weld County, Colorado. Th. Structure Owner owns a permanent man-made sWcture or structtues within 200 feet of the land alTeded by the mining and reclamation operations. The description of the structure(s) is as follows: The telephone line running Crom Weld County Road I to the Pexhell residence in the southwest quarter of Section T, T2N, R68W of the Principle Meridian. Aggregate Industries must obtain permission from Structure Owner in order to conduct operations closer than 200 fu.t to the structures owned by Structtue Owner. In addition, Aggregate Industries must commit to repairing, replacing or compensating Structure Owner for any damage that might be caused [o its structure(s) by the mining ope: anon of Aggregate Industries at this site. 6y this agreement, Aggregate Indusnies requests authorization from Structure Owner to conduct mining operations ~~p to a 30-foot setback hom Stnteture Owner's structure(s). Aggregate Industries commits that, if its operation causes damages to Structure Owner's structure(s) within 200 feet of said operations, Aggegate Industries will repair err replace such structure(s) or compensate Structure Otmer for the value of said structure(s).
