The applicant accepts DMG's bond estimate of 51,325,2G~1.00. <br />6.4.12 Exhibit M -Other Penni[s and Licenses <br />G. There is an existing Section 404 permit related to the original Distel area (Permit No. CO <br />089-74; Corps File # 198913658). The applicant met with Mr. Scott Franklin, Army Corps of <br />Engineers, on December 5, 2000 to discuss the existing permit and the amendment areas fo <br />dett:rmine thr: best option for the entire area. Rased upon the applicant's discussion with the <br />Arrny Cotes of Engineers, the existing permit will continue in place to address mitigation of <br />the Distel ar(•a wetlands. Separate permits for the amendment areas will be obtained from the <br />Array Corps of Engineers as necessary, prior to conducting an activity that requires such <br />per.•rlit(s). Any permits obtained from the Army Corps of Engineers for activities in the <br />amendment areas will be incorporated m[o the mining and reclamation plan as they become <br />available. <br />Six wells arc noted in the adequacy review to be within 600 feet of proposed disturbance (2 <br />weals on Peschell, 1 well on Distell, and 3 wells ott or immediately adjacent to Longmont <br />tracts). However, it should be noted that the two well locations noted on Colorado Division <br />of'vVater Resources records (reproduced following Exhibit C.4 in the amendment application) <br />da not exist. Further review of Division records shows that the City of Longmont well petmit <br />application was denied. Also, the Mountain State well application expired prior to a well <br />being installed on the property. These Peschell property wells are noted as locations "O" and <br />"X" on Exhibit C.4. It should also be noted that the permitted "well" located on the Distell <br />property (noted as location 1 l on Exhibit C.4) is the gravel pit well permit fur the Camas <br />aggregate mining operation. Finally, the three wells noted on or immediately adjacent to the <br />Longmont tract (wells noted as numbers 6, 7 and ]0 on lixhibit C.4) are greater than 600 feet <br />frutn the proposed training area, as shown on Exhibit D. <br />W.: understand that the Office of the State Engineer requires that a waiver of objection must <br />be obtained from all well owners within 600 feet of tlrc permit area, The applicant will not <br />conduct de-watering activities until agreements with all applicable well owners is obtained. <br />1'he applicant is currently amending its existing well permit (No. 50945F) and the substitute <br />supply plan far the current operations to include the amended Peschell and Longmont areas <br />of operation. No groundwater will be exposed in the amendment aeeas without approval of <br />tlu: amended substitute supply plan and the gravel pit u~cll permit by the Office of the State <br />Erginecr. Evidence of a court-approved augmentation plan for Gnal reclamation <br />requirements will be provided to DMG prior to requesting financial warranty release. <br />6.4.19 Exhibit S -Permanent Man-Made Structures <br />8. Attached are agreements that have been obtained wttlt the following owners of man-made <br />"struchtres" within 200 feet of the proposed mine dislurbance limits: <br />• Gary and Mhari M.
