<br />OF PERMANENT MAN-MADE STRUCTURES
<br />THIS AGREEMENT, rntered into by and between CAMAS Colorado, Inc., dba Aggregate Industries,
<br />West Central Region, Inc., hereinafter called "Aggregate Industries", whose address is 3665 S, Teller Street,
<br />Lakewood, Colorado 80231, and:

<br />hereinafter referred to as the "Structure Owner".
<br />The Colorado Mined Land Reclamation Aa requees that lando~titrers adjacent to a proposed mining
<br />operation be in`ortned about the m ine and the reclamation. Further, the Act provides protection for structures that
<br />ate within 200 Feet of a m fining operation.
<br />Aggregate Industries, has submitted an amendment application to the State of Colorado for its Division of
<br />Minerals and Geology Regular 112 Operation Permit No. M-] 989-029, and an amendment application to USR 877
<br />within Weld County, for ::and and gravel mining located at or near Sections 7, 8, 17 and 19, T2N, R66 W of the b's
<br />P,M., Weld Cc•unty, Colorado.
<br />The Structure Owner owns a permanent man-made struchrre or sh tlctures within 200 feet of the lend
<br />affected by the mining and reclamation operations. "[he description of the stncture(s) is as follows:
<br />Tha natural gas and electricity lines running from Weld Couury Road 1 to the Pesehell residence in
<br />the southwest quarter of Section 7, T2N, R68W of the Principle Meridian.
<br />Aggregate lnduslries must obtain permission from Structure thvner in order to conduct operazions closer
<br />than 200 feet to the structures owned by Structure Owner. In addition, Aggregate Industries must commit to
<br />repairing, replacing or rnmpensating Structure Owner Cor any damage that might he caused to its structure(s) by the
<br />mining operation of Aggregate Tndustries at this site.
<br />By Geis agreement, Aggregate Industries requests authoriretion from Structure Owner W conduct mining
<br />operations uF• to a 30-foot setback Crom Structtue Owner's structure(s). Aggregate Industries commits that, if its
<br />operation causes damages to Structure Otvner's smrcture{s) within 200 feet of said operations, Aggregate Industries
<br />will repair or replace such structure(s) or compensate Structure Owner for the value of said 54vettGe(s).
<br />No mining operations are allowed within existing easements. ~1~'~
<br />The parties hereto acknowledge and agree to the above-stated items. ~
