<br />ROCKCASTLE/CMLRD <br />DRAFT AGREEMENT <br />5/30/90 <br />site under §IX of this Agreement. <br />5. The Division and Rockcastle agree that studies submitted <br />by Rockcastle to the Division pursuant to $§ II, III and IV of this <br />agreement shall be acted on directly by the Division under this <br />Agreement rather than as requests for minor or technical revisions. <br />V. BOND RELEASE PROCEDURES AND AMOUNTS -- Rockcastle and the <br />Division agree that Rockcastle will request a prospective bond <br />release for all backfilled and graded areas and for all site <br />reclamation activities, including revegetation to be completed at <br />the Grassy Gap site under this Agreement. The bond release request <br />in the form attached as Attachment A will be submitted to the <br />Division concurrently with execution of this Agreement. <br />Attachment A is incorporated into this Agreement by this reference. <br />1. In addition to information required under 2 CCR 407-2, <br />Rule 3.03.2(1), the release request will contain additional <br />information setting forth the procedures for the prospective bond <br />release as follows: <br />a. The Division will release the bond on a monthly <br />basis pursuant to the procedures of 2 CCR 407-2, Rule 3.03.2, <br />following site inspection and/or review of records describing <br />completed reclamation activities which may be submitted by <br />Rockcastle. The amount of the monthly release will be based upon <br />the amount of material returned to Pit 4 and any other reduction <br />in bond liability as set forth in this Agreement; and, <br />b. The Division will not release any bond monies to <br />Rockcastle until reclamation liability has been reduced to less <br />-6- <br />
