On proposed revised page 2.05- I01, a statement is made that the decreed water rights <br />shown on Map 23 will not be affected by subsidence because they are outside the permit <br />boundary. Please comment on whether or not subsidence could alter the ground water <br />Clow and affect these water rights. <br />5. On proposed page 2.05-104, Section 2.05.6(6), please change the rule heading From <br />(b)(ii) to (b)(iii) since that is the correct rule for a determination that material damage <br />could occur. <br />6. On proposed revised page 2.05-105, in Section 2.05.6(6)(f)(ii)(A), please remove the <br />word "longwall" from the first sentence since this revision does not address longwall <br />mining. <br />7. Please provide proposed revised page 15 of Exhibit 15, Subsidence Prediction, since it <br />was inadvertently left out of the submittal. <br />8. On proposed revised page l9 of Exhibit 15, Subsidence Prediction, the last sentence in <br />Section 2.1, Land Use, lists Freemans Gulch and the stock ponds as those areas where <br />disruption of surface water and ground water would be expected. However, in the <br />approved permit application, on page 18 of Exhibit 15, Stephens Draw is also included as <br />an area where disruption of surface water and ground water would be expected. Please <br />justify this change or show in the permit application where this change has been justified. <br />9. On page 2.05-85 of the approved permit application, it is stated that there aze no springs <br />in the permit or adjacent areas that are of a beneficial use. However, on proposed revised <br />page 2.05-103, the sentence has been changed to say that most of the springs do not have <br />a beneficial use. Please describe which springs have a beneficial use and what that use is. <br />l0. Due to the existence of a fault west of the North Mains, BRL should address the potential <br />for encountering substantial groundwater inflow to the mine workings. Please update the <br />Probable Hydrologic Consequences (PHC) portion of the permit document to include a <br />discussion of the potential for encountering large mine inflows when crossing the fault <br />trace during development mining. Also provide a contingency plan for the safe handling <br />and treatment (if necessary) of mine inflow water that may result from mining in the- <br />vicinity of the fault trace. <br />l 1. information presented in the TR-08 submittal indicates that localized perch water zones <br />will be disrupted due to mining, and may result in mine inflows of short duration. As <br />discussed above, much larger flows may also result from development mining across the <br />fault trace located west of the North Mains. On page 38 of the Subsidence Handbook, <br />BRL indicates that mine inflow monitoring will be conducted and reported in the "Annual <br />Subsidence and Hydrology Report". The Division agrees that mine inflow monitoring <br />should be conducted and reported. <br />2 <br />
