2. Robinson will not commit to anythi setter than the Rules
and Regulations require. That is •1 .'for slopes above
water. I think we all have seen lives ock grazing in the
mountains on slopes that are at least 2h:ly. This is an
amendment to M-78-09 and as such we have revised the slope
grades. I think Robinson would rather not commit to a
definite slope but would rather state the slopes will be no
greater than 2h:ly this leaves them the latitude to make the
slopes 3h:ly if conditions are right.
3. Mr. Heifner did not recommend mulch in his reclamation plan
recommendation. After discussing this with Mr. Heifner he
said mulching the site was unnecessary on this site so we
lv will not commit to it choosing ~to stick with our experts
•~ •~ opinion. MLRB Rule 6.5 and CRS•32-34-116(1)(f) make it the
'~' final responsibility of the operator to insure a di-
~:' verse, effective and long-lasting vegetative cover that is
capable of self regeneration ...". This Robinson is
committed to doing.
4. We would prefer to stick with Mr. Heifner's seeding recom-
s.: ~• mendations. However; if the staff would like to give us a
L~ ~ written guarantee that their mixture will grow we will be
,• glad to use their seed mixture.
E
1. Some of the drainages will
overall direction of drainage
' ~, changed. The only time the
,~: drainages is during times of
): heavy rains. No design work
we donor know what problems
Robinson does not plan to
pattern on the site.
E
be affected by mining. The
in these drainages will not be
are is water flowing in these
runoff, ie after snowmelt or
has been done to date because
may arise in each drainage.
change the overall drainage
This is agreeable with Robinson Brick Company. Thank you.
Exhibit J Vegetation
Hr. Heifner says he used the Visual Estimate of Green Matter
meth~in determining the percentages of ground cover. T e very
s zi a of the affected lands made any other method impratical and
costly to the operator.
Exhibit 1 - Reclamation Costs
I will not argue with you on seed costs. Robinson Brick says
using your figures to calculate the bond at $48,000 is acceptable
and would like to request the bond be set at $48,000.
