D. A. Berry <br />August 28, 1992 <br />Page 2 <br />5) Enclosed is a new drawing number 11-3 which shows the sediment <br />pond configuration as of October 31, 1991. The sediment pond <br />stage filling diagram on the drawing shows that the existing <br />sediment pond configuration satisfies the pond sizing <br />calculations presented in Exhibit 11. Also enclosed is a new <br />Map Index, page xi which incorporates the new map. <br />Other Technical Revision Items <br />Page 2.05-32R was revised to make it clear in the reclamation plan <br />that concrete foundations would be buried on site. <br />Page 2.05-35 was revised to clear up the issue regarding seedling <br />transplants. During the 1990 mid-term review Bear committed to <br />planting narrowleaf cottonwood and willow along the riparian area. <br />See page 2.05-41 paragraph 2 & 3 for this commitment. It was the <br />intent at that time to remove the commitment to transplant the <br />Choke Cherry, Gambel oak and Wood Rose. Item #35 of the 1990 mid- <br />term review document addressed this issue. The mid-term review <br />document asked for a price to transplant seedlings. Bear responded <br />that it did not think that transplanting seedlings was necessary. <br />The Division and Bear agreed to delete the necessity to transplant <br />the Choke Cherry, Gambel oak and wood Rose and replace that <br />commitment with the requirement to transplant cottonwood and <br />willows if necessary as explained on page 2.05-41. <br />Page 2.05-39R was revised to confirm that the concrete foundations <br />would be buried on site. <br />Enclosed is an application for a technical revision which will <br />incorporate the above revised permit pages and maps into the <br />approved permit. <br />Bond Estimate <br />The enclosed document, Attachment 2, titled Bear Coal Company, <br />Inc., Reclamation Estimate Comparison presents Bear Coal Company's <br />position regarding the revised reclamation estimate. <br />Please let me know if you need additional information. <br />Sincerely, <br />Jim Stover, P.E. <br />Consulting Engineer <br />cc: Basil Bear <br />
