I <br />immediately wrote a letter in May asking for details of these violations <br />and assessments since Central West Coal Corporation had not operated since <br />January 1987 and therefore, did not have access to some of this information. <br />To this date, I have not heard any responses to my letter asking for infor- <br />mation so I am taking this means of filing with your office my appeal and <br />objections to many of the named violations. We contend that several of <br />these violations occurred long before Central West Coal Corporation was <br />involved in the State of Missouri, therefore there is no way we were <br />liable on some of the assessments. <br />I would like very much to reach some sort of agreement with O.S.M. and <br />determine exactly what is owed, if anything, and some tonnage method of <br />payment to retire whatever balance we might have in the event we do have <br />some liabilities that can be proven to belong to Central West Coal. This <br />is quite a long and involved scenerio that originated with the-now defunct <br />Midwestern Mining and Reclamation. Central West Coal did begin operation <br />in May 1984 on several of the surrounding leases of Midwestern Mining and <br />Reclamation, therefore it is quite complicated to explain all of the rami- <br />fications of these two companies. <br />I would be most happy to meet in your office at some date agreeable to you <br />and myself to try to resolve this matter which is very important to Central <br />West.
