Both the pre-mine and post-mine land use of the site were industrial use as <br />a railroad siding loadout site. As a result, no bond was issued for the use of the site and the <br />reclamation plan which was approved indicated that following removal of all coal materials <br />associated with the site, it would revert back to an industrial loadout. <br />As final reclamation of the mine occurred in the summer of 1987, the loadout was also <br />reclaimed. An inspection of the site dated May 13, 1988 by the Division indicated that all <br />coal material had been removed and Slurco assumed that the loadout had been released as <br />part of the Phase I bond release for the mine. <br />The question of the loadout was again raised during several conversations with the Division <br />Inspection Staff in 1989. On December 8, 1989, a Permit Revision Application (see attached <br />cover letter) was submitted to the Division to release unmined ]ands in upper Bolton Draw <br />and the release of the loadout site. A requirement of the Permit Revision was the submittal <br />of a Liability Release from the landowner, Wyoming and Colorado Railroad. This was <br />obtained and submitted to the Division (see attached). The Permit Revision was approved <br />by the Division on March 14, 1990 eliminating these lands from the permit and any <br />associated liability. No bond release was associated with this permit revision since there was <br />no bond held on either of the two areas. <br />
