Rule 2.03.4(6)(x): The permit currently identifies the names and addresses of only those surface property owners whose property will be affected by surface operations and facilities (proposed page 2.03-14, rev. 2/24/99), but not of all surface property owners within the Foidel Creek Mine's permit boundary. While supplying the names and addresses of only those surface property owners whose property will be affected by surface operations and facilities is a literal interpretation of rule 2.03.4(6)(x), it is a requirement of our state law, at 34-32-1 10(Z)(b)(i), that applications contain the name and address of all owners (surface and mineral) of the property to be mined. Please provide, therefore, for insertion into the permit, the names and addresses of any additional entities that own surface property within the mine's permit boundary that are not currently identified. Please be sure that these names and addresses correctly coincide with the names provided on Map 1, "Surface Ownership" (certified 2/26/99). 18. Rule 2.03.4(6)(b): The permit currently contains a paragraph that states, "The only holder of leasehold interest in the coal to be mined is Twentymile Coal Company..." (p. 2.03-16, rev. 3/4/98). Please indicate in the response to our adequacy letter whether this paragraph is still accurate. If not, please provide a replacement permit page reflecting all appropriate changes. If this paragraph is still accurate, then no replacement permit page is required. 19. Rule 2.03.4(6)(c): The permit currently contains a paragraph that states, "Twentymile Coa] Company (formerly Cyprus Western) is the owner of record of all areas to be affected by facilities incidental to the underground mining operations..." (p. 2.03-16, rev. 3/4/98). Please indicate in the response to our adequacy letter whether this paragraph is still accurate. If not, please provide a replacement permit page reflecting all appropriate changes. If this paragraph is still accurate, then no replacement page is required. 20. Rule 2.03.4(7): "Andrew M. Hunter III" is shown on Map 1, "Surface Ownership" (certified 2/26/99), as a surface owner contiguous to the permit boundary in Section 9, T4N, R86W. If this is the same person as "Andrew Hunter" as indicated on existing permit page 2.03-I8 and on proposed permit page 2.03-18.1, then please make these two names consistent between Map 1 and the permit text. If these are two different Andrew Hunters, then please add "Andrew Hunter" to Map 1, and add "Andrew M. Hunter III' to the lists of names and addresses in the permit.
