Long <br />Division Dvenor <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Pazagraph 3, of the Colorado Revised Statutes, that on August 11, 1997, an application to <br />renew an existing peratit to conduct coal mining operations at the Munger Canyon Mine was considered <br />complete for the purposes of filing. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />The applicant proposes to continue underground coal mining and/or reclamation operations on land located <br />approximately 18 miles north of Loma, Colorado. The permit azea is further described as follows: <br />Mine site: Portions of Sections 21, 27, 28, 29, 32, 33, and 34, T7S, R102W, 6th P.M., all in Garfield <br />County. <br />Portions of Sections 2 and 3, T8S, R102W, 6th P.M., all in Garfield County. <br />Rail Loadout: Portions of Section 23, T2N, R3W, Ute PM, in Mesa County. <br />Portions of Section 3, TIN, R3W, Ute PM, in Mesa County. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Howard & <br />Garvey Canyon (mine) and Mack (loadout). <br />The application is for renewal of an existing permit, and would not incorporate additional lands into the <br />permit area. No change to previously approved permit conditions, reclamation requirements, or mitigation <br />measures has been proposed. <br />In order for us to approve this renewal, we are required to make a finding that "the activities would not <br />affect the continued existence of endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats as determined under the Endangered Species Act of 1973...."
