~~ <br />NOTICE OF PROPOSED DECISION <br />iii iiiiiiiii <br />The Colorado Division of Minerals and Geology proposes that an application to <br />renew a valid, existing permit to conduct coal mining and reclamation <br />operations submitted by the Colorado Yampa Coal Company for the Energy Mine <br />No. 3 Mine be approved with conditions. <br />The Energy Mine No. 3 operation is located in Routt County, approximately <br />15 miles from Steamboat Springs, Colorado. Mining has ceased at this <br />operation and activities proposed over the next five years are limited to <br />monitoring activities associated with vegetation reestablishment and the <br />hydrologic regime. The mined coal was privately and state owned, and the <br />affected surface is privately owned. The permit area encompasses <br />approximately 1,397 acres in Sections 1, 2, 12, 13 and 24, TSN, R86W; and <br />Sections 18 and 19, TSN, R86W. <br />This proposed approval decision is based on a finding that the proposed <br />operation will comply with all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-101, et sec., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision including stipulations, are on file for public <br />inspection at the Colorado Division of Minerals and Geology, Room 215, <br />Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the <br />Routt County Clerk's Office in Steamboat Springs, Colorado. Persons with an <br />interest that may be adversely affected by the proposed decision may request a <br />formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within thirty (30) days of the initial <br />publication of this notice, must be in writing, and must state with reasonable <br />specificity the reasons for the request and the objections to the proposed <br />decision. <br />
