(BMRI) <br />SAN LUIS MINE, CMLRB PERMIT NO. M-88-1 ] 2 <br />Deaz Mike: <br />On November 16, 1998 BMRI submitted a revised Response Plan in accordance <br />with the requirements of TR-15. This Plan summarized the data and analyses conducted <br />to date to chazacterize the elevated total dissolved solids (TDS) levels previously <br />identified in monitoring well M-11R and the response measures, including interim <br />containment, which have been implemented by BMRI. The Plan also sets forth the <br />technical studies BMRI believes aze necessary to fully characterize the sturoundigg <br />hydm~eology in su$tcient detail to allow the evaluation and design of long term response <br />measures and establishes a schedule for their implementation. <br />BMRI would like to propose that an item be scheduled on the agenda for the <br />December Board meeting to allow BMRI and the Division to make a presentation <br />regarding the cturent understanding of the nature of the TDS problem, the interim <br />response measures in place at the site, and the schedule and approach outlined in rile <br />Response Plan for long term response measures. As we have discussed, it is BMR!'s <br />preference that the Response Plan be incorporated into an enforceable compliance order <br />and we therefore waive the required notice period as necessazy to accommodate a formal <br />public hearing to consider and approve a mutually agreeable order. <br />In this regard, we would request that we commence discussions regarding the <br />possible terms of such an order as well as working out any differences of opinion <br />regazding the elements of the Response Plan as soon as possible.
