NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to Approve with conditions Permit Revision <br />Application No. 2, submitted by Seneca Coal Company for a coal mining permit at the Yoast Mine (Permit <br />No. C-1994-082). This Permit Revision updates the life-of--mine plan for the Yoast operation, and contains <br />modifications to the mining, reclamation and associated plan and acreages for the remaining life-of- <br />operation. Several factors and other internal considerations have resulted in a corporate decision by Peabody <br />Energy to cease coal production at the Yoast mine in early 2006. This Permit Revision is a result of this <br />decision, and addresses the revised mining plan and the revised bacl~lling and grading schedule. The <br />operator is proposing an overall reduction in disturbed azea and affected azea acres. <br />The Yoast Mine is located in Routt County, approximately 7 miles southwest of Hayden, Colorado. Coal <br />interest is Federal and private, and the surface to be affected is Federal, state and private land. The permit <br />azea encompasses approximately 2,318.30 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all requirements <br />of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the <br />regulations promulgated thereunder. <br />Copies of the proposed decision, including any stipulations, aze on file for public inspection at the Colorado <br />Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado <br />80203 and at the Hayden Public Library, PO Box 1813, Hayden, CO 81639. Persons with an interest that <br />may be adversely affected by the proposed decision may request a formal hearing before the Mined Land <br />Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the <br />initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for <br />the request and the objections to the proposed decision. <br />
