Box 823 <br />Hays, KS 67601 <br />RE: Munroe Quany, Permit No. M-77-002 HR, Amendment No. 1 <br />Dear Mr. Taylor: <br />OF. ep/O <br />RE 4 <br />~e <br />..~~g; <br />Roy ROmer <br />Governor <br />Michael8 Long <br />Drviswn Director <br />The Division of Minerals and Geology has approved the Amendment No. 1 application for the <br />Munroe Quarry, Permit No. M-77-002 HR on December 29, 1993. The application was found to <br />be adequate and in accordance with the Mineral Rules and Regulations of the Colorado Mined Land <br />Reclamation Board. <br />The Division had received your timely objection letter of December 6, 1993 and reviewed it <br />carefully before the decision was made to approve the permit. In your objection letter you had the <br />following concerns: <br />a. No easement agreement to access the property for the 2 (two) adjoining and existing <br />acres 5 acres; <br />b. The location of the proposed mine is closer to your living quarters and will create <br />dust, noise and other health hazard for animals and people. <br />The Division was provided on December 27, 1993 a copy of an easement agreement signed by <br />Mrs. Gladys Munroe and Colorado Lien Company which allowed them an easement and access to <br />the property. <br />As to the dust and noise that would be caused by the operation, the Division of Minerals and <br />Geology has no authority over these unless the dust is wind blown from an existing tailings within <br />the permit area. The operator has submitted a dust control plan within the permit area which was <br />reviewed and found to be adequate. You can contact the Colorado Department of Health, Air <br />Emissions Control Division, which has the authority to enforce air emissions control. <br />However, you have the right to object the Division's decision to approve the amendment to the <br />Colorado Mined Land Reclamation Board in accordance with Rule 110(2)(b)(5)(d) of the <br />Minerals Rules and Regulations. <br />
