BANTA, Director <br />duly 6, 1989 <br />Montrose County Board of Commissioners <br />Box 1289 <br />Montrose, Colorado 81402 <br />Attention: Mr. Pat Warren <br />RE: Nucla Mine, Liability Release, File No. C-81-008 <br />Dear County Commissioners: <br />The Colorado Mined land Reclamation Division is proposing to approve a request <br />for full liability release, submitted by Peabody Coal Company, 1300 South <br />Yale, Flagstaff, Arizona, 86001, for their Nucla Mine in Montrose County. <br />The Division's decision is to release liability only, on the landfill area <br />which is situated within the northeast portion of the permitted area. More <br />specifically, it encompasses mine areas 4 and 5, the temporary bypass to <br />county road AA, and topsoil stockpile #l, which includes topsoil stripped from <br />the temporary bypass road. The Division has made a finding that Peabody Coal <br />Company has met all its reclamation obligations for this portion of the Nucla <br />Mine. <br />The Division will be accepting specific written comments and requests for an <br />adjudicatory hearing from anyone with a valid legal interest which may be <br />adversely affected by this proposed decision.
