We feel that the potential solution represented by the <br />technical revision is a good-faith effort to deal with the situation at the loadout facility. <br />In that regard, please realize that our adequacy questions do not represent any unusual level of <br />scrutiny. These are standard questions that must be answered in auy and every case to comply <br />with specific regulatory requirements. Please recognize that the Kerr Coal Company revision <br />involves five issues that are significant from a regulatory standpoint: <br />1) proposal of an alternate land-use; <br />2) proposal of a change in the reclamation plan; <br />3) disposal of "coal mine waste;" <br />4) retention of a permanent impoundment; and <br />5) extension of the permit area. <br />Each of these proposed actions triggers some specific requirements and our adequacy letter <br />described those. <br />We will be happy to meet with Kerr Coal Company representatives to discuss these issues. <br />Please feel free to contact me at any time. <br />Sincerely, <br />James R.
