The purpose of this memorandum is <br />to provide you, as requested under the reference, information on these holes being transferred. As <br />of this date, a number of these holes will need to be added to Colowyo Coal Company, L.P.'s <br />(Colowyo) request to you to modify the NOI, and a number of questions still need to be resolved. <br />Answering your second question first, all surface disturbances associated with an exploration hole <br />aze being transferred with the hole. <br />As part of the TR-50 process, Table 1 of the application is being revised to identify all the holes to <br />be transferred. The following is an overview of the holes on the current table. The Minor Revision <br />(MR) files referenced have information on the holes and surface disturbances. Table 1 indicates <br />the MR associated with each hole. Please let me know if you need assistance in reviewing these <br />files or duplicating them for your NOI records. Perhaps your NOI files can include the MR file by <br />reference. <br />Holes 1, 3through 8, 26, 27, 33, 35, 37, 45, 46, 101 and 102 were permitted in the original Permit <br />C-81-019. They are shown on Map 10 and aze referred to on page 2.04.7-5 of the Permit <br />Application Package (PAP). Reclamation liability was released in MR 12 for these holes. <br />Holes IP#1, IP#2 and IP#3 were permitted under MR 34 and were mined through. In my draft <br />letter to Colowyo I ask that these holes be added to Table 1. <br />In a draft letter to Colowyo, I ask Colowyo to identify a number of holes permitted under MR-44 <br />that have not been identified to date. MR-44 indicates that they were to have been mined through. <br />How the Division is going to proceed with 13 wells licensed with the Office of the State Engineer <br />is still in question. Colowyo as a permittee wishes to transfer these wells to Colowyo as a <br />landowner, and be relieved of any reclamation liability (no bond) for these wells under Permit C- <br />81-019 or any NOI. These wells are MJ 95 O1, MJ 95 02, M1 95 03, MT 95 Ol, MT 95 02, MW 95 <br />O1, MW 95 02, UL 95 O1, UL 95 40, UL 95 45, W 95 02, W 95 l 1, and W 95 l5. These wells <br />STATE, OF COLORADO <br />
