Gunnison No. 1 Mine Technical Revision No. 52, Bear No. 1 Portal <br />Area - MB-5 Sediment Pond Dewatering Device/Emergency Spillway <br />Relocation, File No. C-80-007 <br />Dear Mr. Conn: <br />The technical revision request for a dewatering device and emergency spillway <br />relocation for Sediment Pond MB-5 has been approved. Enclosed is the revision <br />decision document. You may proceed with publication of the approved <br />decision. The Division will pay for publication of the notice. <br />Please be aware that sediment ponds shall be designed and inspected during <br />construction under the supervision af, and certified by a qualified registered <br />professional engineer (P.E.), Rule 4.05.6(7). In light of this requirement, <br />the Division requires WECC to submit 1) by September 12 a statement and <br />certification by a qualified registered P.E. that all detention time and <br />spillway size calculations and graphs submitted in the August 14, 1986 <br />adequacy response are true and accurate, and 2) within 30 days after <br />construction of the principle spillway and emergency spillway relocation a <br />statement and certification by a qualified registered P.E. that all components <br />of Sediment Pond MB-5 are functioning properly and are fully capable of <br />processing flows from a 10-year, 24-hour event with sufficient detention time <br />to meet NPDES effluent limitations and can safely discharge runoff from a <br />25-year, 24-hour precipitation event. Because of requirement 2, WECC should <br />submit to the Division a brief statement of when all construction work, per <br />Technical Revision No. 52, has been completed. <br />Please feel free to call me or Bob Liddle if you have any questions regarding <br />these requirements. <br />Sincerely, <br />~S~'i' I LL~ <br />Thomas A.
