NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology (Division) has issued <br />a proposed decision to approve Bond Release Application No. 5 <br />(SL-5) for the Raton Creek Mines; Permit No. C-1982-055. Energy <br />Fuels Mining Company operates the mine under the provisions of the <br />Colorado Surtace Coal Mining Reclamation Act of 1979. Energy <br />Fuels Mining Company submitted the bond release application on <br />August 8, 2005. This bond release 9ranM approval for a partial Phase <br />I and a full Phase II and Phase III band release (SL-05) for 30.6 acres <br />of disturbed area, including all permanent structures, dhches, and the <br />single sediment pond, and about 117 acres of affected area within the <br />permit area at the Raton Creek Mine. The permit area is 7,370 acres <br />of which 30.6 acres were disturbed during operations. The permit <br />area is located within portions of: <br />SW7l4, Section 31, T33S R63W; <br />All of Section 36 except portions of W1/2 Wi/2, T33S R64W; <br />All of Section 6, T34S R63W; <br />N7/2 NE1/4, NEl/4 NW7/4, Section 7, T345 R63W; <br />E1/2 E7/2, Et/2 SE7/4, Section 1, T34S R64W of the 6th P. M. <br />The area is shown on the U.S.G.S Trinidad East, Colorado, 7.5 <br />Minute Ouad Map. The area is generally located about one mile <br />southeast of ExR it along Interstate 25 south of Trinidad, Colorado In <br />Las Animas County. .. <br />The ownership of the land surface and the minerals for which bond <br />release has been requested is private. Reclamation of the disturbed <br />land began In 1991 and permanent seeding was completed In 1995. <br />The Phase I portion of this bond release request applies to a number <br />of structures antlfeatures previously excluded from tour, prior bond <br />release applications (SL-01 to SL-04) tar which the Division issued a <br />decision and completed a wriden finding. This bond release (SL-05), <br />If it becomes final, would terminate all jurisdiction of me Division and <br />the MLRB at the site. ' <br />Copies of the proDOSed decision are available for review at the <br />Colorado Division of Minerals and Geology office, 1313 Sherman <br />Sireel, Room 215, Denver, Colorado 80203, and at Me office of the <br />Las Animas County Clerk and Recorder. <br />Any person who has an interest that is, or may be, adversely affected <br />may request an adjudicatory hearing regarding this proposed deci- <br />sion.
