PCPC <br />Re: SUP2002-005 <br />6/11/2002 <br />Page 3 <br />policy shall specifically cover the acts and operations of any subcontractors or independent <br />contractors of the applicant in addition to the applicant's employees or agents. <br />13. Future reviews of Special Use Permit No. 2002-005 will be scheduled only if there is a <br />violation of the Pueblo County Code or the conditions of approval, or if a review is <br />specifically requested by the Pueblo County Planning Commission. <br />LOCATION (Exhibits 1-3) <br />The property containing the gravel operation is approximately one mile southeast of the St. <br />Charles River, 2.0 miles south of State Highway 50 East, 0.6 mile east of Conner Road, and <br />300 feet south of the Bessemer Ditch. The site contains 120± acres, and is described as a tract <br />containing 103± acres located in the N'/~ NE'/a and the SE'/< NE'/<, and a 16.71-acre tract in the <br />N''/z SE'/< of Section 24, Township 21 South, Range 63 West of the 6th P.M. <br />BACKGROUND <br />Special Use Permit No. 609 was approved December 16, 1986 for 170± acres known as <br />Cortner Pit #2, with five conditions of approval, including cone-year review. SUP No. 609 was <br />again approved December 22, 1987, with seven similar conditions of approval: <br />1. The applicant shall submit a copy of the present MLRB 110 permit to the Department of <br />Planning and Development within ten (10) working days of this December 22, 1987 <br />approval. <br />2. Within 10 working days of this December 22, 1987 approval, the applicant shall contact <br />the Pueblo City-County Health Department to schedule an on-site inspection for the <br />purpose of obtaining final approval of the Emissions Permit. <br />3. The applicant shall provide the Department of Planning and Development with a copy of <br />any future MLRB applications, permits, or amendments pertaining to Special use Permit <br />No. 609 within 30 days of their submittal to or approval by the MLRB. <br />4. The applicant shall provide the Department of Planning and Development a copy of any <br />future local, State, or Federal permits within 30 days of their issuance. <br />5. The applicant shalt conduct the gravel operation in such a manner as to not damage the <br />Bessemer Ditch or the natural gas transmission line. With respect to the gas <br />transmission line, the extraction shall be done in accordance with the terms and <br />conditions set forth in the letter from the Colorado Interstate Gas company to Pueblo <br />County, dated December 16, 1986, and entered into the record at the Commission's <br />hearing as "Applicant's Exhibit 2, SUP #609." <br />6. The applicant shall continue to apply a dust palliative, as determined by the County <br />Road and Bridge Department to a section of Cortner Road which runs in a <br />northeasterly-southwesterly direction adjacent to the Gage property in Section 13, as <br />described by the applicant (in Exhibit 4 of staff's December 14, 1987 review). This dust <br />palliative will be applied only when the applicant is hauling on the above described <br />roadway section. <br />
