In order to comply <br />with the minimum requirements of the Act and Mineral Rules and Regulations the following <br />items need to be addressed: <br />1) Exhibit C(a) outline refers to Exhibit O for names of adjoining landowners. However, <br />Exhibit O lists the surface and subsurface owners of the affected land and does not reflect <br />the adjacent land owners unless they are one and the same. Please clarify. <br />2) Does the Newton 2 ditch lie within 200 feet of the affected land boundary? If so, it must be <br />shown on Exhibit C map and must be addressed in Exhibit S. <br />3) Exhibit C(c) -the darkened contour lines are 25' intervals not 20' intervals. Please revise. <br />4) Exhibit C(d) -the total permit area will contain 58 acres. Will the affected land area <br />contain the same acreage or will it be less than the permit area? If less than the permit area, <br />the affected land area must be clearly delineated on all the maps. Please address. <br />5) Exhibit C(g) states that the map shows the owner's name of any structure within 200' of the <br />affected land. As noted in paragraph 2 above. if the Newton 2 ditch is within 200' of the <br />affected land area it must be shown on Exhibit C map along with the owner's name and, <br />also, addressed in Exhibit S. <br />6) Exhibit D(c) - Exhibit I does not explain potential groundwater conflict. Should show amended area too. <br />Please address. <br />
