NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to approve an application for partial Phase One Bond <br />Release submitted by Bowie Resources Limited for the Bowie No. 1 Mine, Permit Number C-1981-038. The <br />proposed decision is based on successful completion of structural demolition and removal and portal sealing at <br />the East Mine and structural demolition, portal sealing, backfilling and grading work and drainage control at the <br />West Mine, within specified portions of the permit area as described in the bond release application. in <br />addition, the Division is proposing to approve an application submitted by Bowie Resources Limited for a bond <br />reduction for the reclamation of certain facilities that were never constructed. The mine is an underground coal <br />operation located in Delta County approximately four (4) miles north of Paonia, Colorado, with the loadout <br />located approximately one (1) mile east of Paonia, Colorado. The permit area contains approximately 8,670 <br />acres of land within the following sections: <br />Tnwn¢hin 1'i Snnth„$ange 97 Wectrl~~' P M_ <br />Sections: I, 2, 10, 11, 12, 13, 14, 15, 22, 23, 24 and 25 <br />Township 1't Snnth,TRange_9~ WectYF~' P M <br />Sections 5, 6, 7, 8, 17, 18, 19, 29, 30, 31 and 32 <br />The permit area is contained within the U.S. Geological Survey 7.5 minute Bowie and Gray Reservoir <br />Quadrangle maps. <br />In the partial Phase One Bond Release (SL-02), the Division is proposing to release a total of $1,143,807.00 for <br />the structural demolition and disposal and portal sealing at both the East Mine and at the West Mine and <br />backfilling and grading work and drainage control at the West Mine, as detailed in the Division's Proposed <br />Decision and Findings of Compliance for the Partial Phase One Bond Release (SL-02). Also included in the <br />bond release amount is a bond reduction for the reclamation of the rock slope tunnels and two associated <br />culverts at the East Mine, which were never built. The total reclamation liability at the Bowie No. 1 Mine <br />amounts to $6,879,590.00. With the proposed decision to approve SL-02, the total reclamation liability will be <br />$5,735,783.00. The Division currently holds a performance bond for the Bowie No. 1 Mine in the amount of <br />$6,450,000.00, in the form of a cash bond held by the Colorado Secretary of the Treasury for $1,000,000.00 and <br />in a corporate surety amounting to $5,450,000.00 issued by the CGU Insurance Company. Enough bond money <br />will be retained in order to perform the remaining reclamation tasks at the Bowie No. 1 Mine. <br />A copy of the "Proposed Decision and Findings of Compliance" is on file for public inspection at the Colorado <br />Division of Minerals and Geology, Room 215 Centennial Building, 1313 Sherman Street, Denver, Colorado <br />80203, at the Paonia Public Library, 140 Grand Avenue, Paonia, CO 81428 and at the Delta County Clerk's Office, <br />5th & Palmer, Delta, CO 81416. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may request <br />a formal public hearing before the Mined Land Reclamation Board in accordance with Rule 3.03.2(6). The <br />request must be in writing and must state, with reasonable specificity, the reasons for requesting such a hearing. <br />All requests must be submitted to the Colorado Division of Minerals and Geology, 1313 Sherman Street, Room <br />215, Denver, Colorado, 80203. Public notice of this proposed decision will be published twice in the Delta <br />County Independent as soon as possible. Requests for public hearing must be received by the Division within <br />thirty days of the first publication in the Delta County Independent. If no hearing is requested within that thirty <br />days, the Division's decision will become final. <br />
