Banta, <br />Division Director <br />Re: Technical Revision to SAE Demo for TDL Item 2 of 4 at the New Elk Mine <br />(Our File No. C-81-012, TR - 23) <br />Dear Mr. Francone: <br />We have received your technical revision application to revise your permit (File <br />No. C-81-012) to conduct coal mining in Colorado. Our initial review indicates <br />that all preliminary items required by the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. 34-33-101 et seq., have been submitted; thus your technical revision <br />application has been deemedcomplete for the purposes of filing on the above date. <br />All review and comment periods as provided in the Act and Regulations promulgated <br />thereunder initiate from this date of filing. <br />A copy of the technical revision application, less any confidential information, <br />must be filed for public inspection with the Las Animas County Planner or Clerk and <br />Recorder. Any subsequent changes or additions must also be made in this copy. <br />The proposed newspaper advertisement submitted with the application has been found <br />to be satisfactory. You should commence publication of this advertisement as <br />specified in Rule 2.07.3.(2) of the Regulations with the exception that the <br />publication need only be run once, and reference to the informal conference <br />specified in Rule 2.07.3(2)(d) should be deleted. Proof of the publication of the <br />advertisement must be filed with the Division as soon as available after the <br />publication date. <br />The staff is currently reviewing your technical revision application to determine <br />whether the items you have submitted are adequate in terms of meeting the <br />requirements for purposes of adequacy. You will be notified as to the Division's <br />findings of adequacy or inadequacy of your revision application. The Division will <br />render a proposed decision on or before August 26, 1991. <br />The operator has to inform the Division where the Technical Revision pages should <br />be inserted into the permit document.
