<br />OF PERMANENT MAN-I11ADE STRUCTURES
<br />THIS AGREEMENT, entered into by and between CAMAS Colorado, Inc., dba Aggregate Industries,
<br />West Central Region, Inc., hereinafter called "Aggregate Industries", whose address is 3605 S. Teller Street,
<br />Lakewood, Colorado 8023.>, and:

<br />hereinafter refi.rred to as the "Structiue Owner".
<br />The Colorado Mined Land Reclamation Act requ'ves that lando~t~ters adjacent to a proposed mining
<br />operation be informed about the mine and the reclamation. Further, the Act provides protection for structures that
<br />are within 20(i feet of a mining operation.
<br />Agln'egate Industries, has submiried nn ametdment application to the State of Colorado for its Division of
<br />Minerals and Geology Regular 112 Operation Permit No. M-1984-029, and an amendment application to USR 877
<br />within Weld County, for :and and gravel mining located at or near Sections 7, 8, 17 and 19, T2N, R68W of [he 6`''
<br />P.M., Weld County, Colorado.
<br />The Structure Owner owns a permanent man-made structure or snucttues within Z00 Ceet ofthe land
<br />affected by the mining and reclamation operations. The description of the structure(s) is as follows:
<br />The natural gas and electricity Gnes rnoniug from Weld County Road 1 to the Paschall residence in
<br />the southwest quarter of Section 7, T2N, R68W of the Prineiple Meridiaa.
<br />Aggregate lndustries muss obtain permission from Structure Owner in order to conduct operazions closer
<br />than 300 fee- to the structures owned by Shvctwe Owner. In addition, Aggregate Industries must commit to
<br />repairing, replacing or compensating Structure Owner for any damage that m fight be caused to its structure(s) by the
<br />mining operation of Aggregate Industries at this site.
<br />By this ageenter~t, Aggregate Industries requests authoriretiott frotn Structure Owner to conduct mining
<br />operations t.p to a 30-foot setback from Structure Owner's structure(s). Aggregate Industries commits that, if its
<br />operation causes damages to Structure Owner's stnwture(s) within 200 feet of said operations, Aggregate Industries
<br />will repair cR replace such structure(s) or compensate Structure Owner for the value of s/aJid strucntre{s).
