<br />AGREEMENT TO MWE WITIlIN 200 FEET
<br />OFPERMANENT MAN-MADE STRUCTURES
<br />TEIIti AGREEMENT, entered into by and between CAMAS Colorado, Inc., dba Aggregate industries,
<br />West Central Region, Inr,., hereinafter tailed "Aggregate Industries", whose address is 3605 S. Teller Sheet,
<br />Lakewood, Colorado 90235, and:
<br />Left Hand Water District
<br />P.O. Box 210
<br />Niw~~t, Colorado 80544-0210
<br />hereinafter referred to as the "Structure Owner".
<br />'Ihe Colorado Mined Land Reclamation Aet requves that landowners adjacent to a proposed mining
<br />operation be :nformcd about the mine and the reclamation. Further, the Act provides protection for structures that
<br />are within 209 feet of a mining operation.
<br />Aggregate Industries, has submitted an amendment application trt the State of Colorado for itr Divisimt of
<br />Minerals and Geology Regular 112 Operation Permit Nu. M-1989-029, and an amendment application to USR 877
<br />within Weld County, for sand and gravel mining located at or Dear Sections 7, 8, l7 and 19, T2N, R68W of the 61b
<br />P.M., Weld County, Colorado.
<br />The StrucRUe Owner owns a petmanentman-made structure or structures within 200 feet of the land
<br />affected by Ute mining and reclamation operations. The description of the structure(s) is as follows:
<br />The water Gae ruuoiug north-south along Weld County Road 1.
<br />.Aggregate Industries must obtain permission from Structure Ovnter in order to conduct operations closer
<br />than 200 feet to tho stncnues owned by Structure Owner. In addition, Aggregate Industries must commit to
<br />repairing, replacing or compensating Structure Owner for any damage Otat might be caused to its structure(s) by the
<br />mining operation of Aggregate industries at this site.
<br />By this agreement, Aggregate Industries requests authorizrtion fi'om Structure Owner to conduct mining
<br />operations u? to a 50-foot setback from Structure Owner's structure(s). Aggregate Industries commits that, if its
<br />operation causes damages to SWcture Owner's structure(s) within Z00 fi.~ct of said operations, Aggregate Industries
<br />will repair or replace such structure(s) or compensate Structure Owner for the value of said structure(s).
<br />The: parties hereto acknowledge and agree to the above-stated items.
