Comparison of actual post-mining topography to ground configuration observed during the field <br />inspections indicate the applicant has achieved the approved post-mining topography. As-built, <br />surveyed cross-sections are included in the PAP as Figures 2.05.4-1 through 2.05.4-5. No sign of <br />instability, slumps, slides, or damage were observed during field inspection. There was no <br />evidence noted during the bond release field inspections or during other inspections that would <br />indicate potential, future instability. The reclaimed area is above the water table in all azeas and <br />development of springs or seeps is not anticipated. Drainage channel gradients appear <br />appropriate for the topography and future function should enhance stability. Drainage continues <br />to flow as approved to sediment ponds during the pre-Phase II bond release period. <br />Other than the outfalls of each sediment pond, no water monitoring occurs in the 122.1 acres that <br />are the subject of this Phase I bond release application. Pollution of surface or ground waters is <br />not anticipated. Completing the remaining reclamation is not considered difficult. Hydroseeding <br />steep slope areas, although routine, may be the most difficult reclamation task remaining. <br />In conclusion, there was nothing observed during the bond release inspections, nor is there any <br />outstanding issue or problem that would preclude approval of this Phase I bond release for 122.1 <br />acres of reclaimed azea of the Lorencito Canyon Mine. <br />Proposed Decision <br />The Colorado Division of Minerals and Geology (DMG) approves an application for a Phase I <br />bond release for a portion of the Lorencito Canyon Mine. This bond release applies to 122.1 <br />acres of the disturbed area as described in earlier sections of this document. The required <br />amount of bond to be held by the Division to complete any remaining reclamation will be <br />reduced from $2,476,076.00 to $1,000,240.00, a reduction of 59.6%, as limited by Rule <br />3.03.1(2)(a). The amount to be released is $1,475,836.00. As required by Rule 3.03.1(2)(d), the <br />bond amount of $1,000,240.00 is an amount sufficient to ensure completion of all remaining <br />reclamation in accordance with the approved plan at this time. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published twice <br />in the Chronicle-News for two weeks as soon as possible. Requests for a public hearing must be <br />submitted to the Division in writing within thirty (30) days of the first publication of the notice in <br />the Chronicle-News. If no hearing is requested within 30 days, the Division's proposed decision <br />will become final. <br />
