Dear Mr. Miller:
The Division completed a technical review of your conversion application. In order to meet
the minimum requirements of the ActJRules and Regulations, the following items need to be
addressed:
1. Pursuant to Rule 6.2; requirements (a), (b) and (c), the Exhibit maps must show the
name of the Applicant, must be signed by the person (s) who prepared the maps and
must give the date they were prepared. Please revise the maps.
2. The location description on Exhibit A does not correspond to the location information
on page 2, paragraph 9 of the application. The application states that the site is
located in Section 29, Township 28 South, Range 47 West. Exhibit A states that the
site is located in Section 25, Township 28 South, Range 47 West. Which location is
correct?
3. Exhibit B shows the site location east of lI5 highway 287. The other Exhibits show the
site west of 287. Which is correct?
4. Please provide the total excavated depth of each pit (north and south of Sand Creek).
5. It appears that mining activities will occur some distance from Sand Creek. If there is
a set back from Sand Creek, please provide the set back distance(s). If a set back is not
being proposed, please describe how the Creek will be protected.
6. You propose to install a diversion dike to divert stormwater runoff to a "safe disposal
site." What is a "safe disposal site" and where will it be located? The structure must be
shown on the maps. If the disposal site is a retention pond (collection pond), you
need to provide construction specifications.
Where will the diversion dike be located? It, too, must be shown on the maps. How do
you propose to construct the dike? What are the dimensions of the dike?
