LOng <br />Division Director <br />I finally have had an opportunity to review your correspondence dated July 10 and 11, 1995 <br />regarding a few outstanding matters at the San Luis Mine. As you stated in your Judy 11, 1995 <br />letter, the problem you have with the M-14 well will be resolved this month. When it is resolved, <br />send me a letter outlining what was done to take care of the problem. Also, you stated that the size <br />of the containment area for the make-up water tank overflow had to be reduced because of "the soft <br />ground in the southwest comer." Please provide the Division with an as-built drawing of the final <br />structure so an accurate document can be placed in the files. <br />In your July 10, 1995 letter, you outlined the then current status of several outstanding items. There <br />have been quite a few changes since July 10, including: (1) the Division's approval of TR-017 and <br />conditional approval of TR-018, (2) your response to the M-14 monitoring well problem, (3) your <br />submittal of TR-023 addressing the discontinuation of monitoring requirements for ten piezometers <br />and the once-a-week sampling of the Inco tailings, and (4) your response to the spigot distance issue. <br />The list of outstanding issues grows smaller every month. <br />As you pointed out in pazagraph E of your July 10, 1995 letter, you will be submitt[ng an <br />amendment (technical revision) to the permit changing the post-mining land use for the old office <br />site. You indicated a concern about my request for water samples from the water wells at the site. <br />The reason I suggested taking samples from the water wells is in regard to the requirement of <br />Rule 3.1.7(8), which states, "An operator shall demonstrate, to the satisfaction of the Office, that <br />reclamation has been achieved so that existing and reasonably potential future use of groundwater <br />are protected." You may not be able to demonstrate protection of groundwater without sampling the <br />water wells. If you can demonstrate that the groundwater was not adversely impacted from the heap <br />leach operation without the water samples, then provide the information when you subn3it your <br />release request. <br />
