Lnc hheaA <br />Executive Onedor <br />M¢hael B Long <br />Oivnion Dueao~ <br />Enclosed you will find the Division of Minerals and Geology's Proposed Decision Package for Permit Renewal <br />No. 03 at the West Elk Mine. Notice of the proposed decision will be published in the Delta County <br />Independent as soon as possible. The first publication will initiate the [hiny (30) day public comment period <br />for the Division's decision. <br />Documentation must be submitted to the Division demonstrating that a copy of the approved revision application <br />was sent to [he Office of Surface Mining and the Bureau of Land Management. The material should be sent <br />within 15 days of final approval. <br />The Division estimates the increase in reclamation liability for mining operations in this permit renewal to be <br />$6,145,344.00. However, Mountain Coal Company (MCC) is pursuing aself-bonding option at this time, and <br />an appropriate bond amount has not been finalized. Stipulation No. 59 has been added to the findings document <br />to address the pending bond issue. MCC will continue to work with the Division to finalize an appropriate bond <br />amount in a timely manner.
