Rule 2.05.4(2)(E) <br />Revised 8/15/84 <br />• Section 816.116(a) Continued. <br />The use of the indicated reference area represents a change from <br />Kerr Coal's original proposal for measuring revegetation success at <br />the Kerr Tipple Area on the basis of surface erosion conditions. <br />(b)(1) Ground cover and productivity of living plants on the revege- <br />tated area within the permit area shall be equal to the ground cover and <br />productivity of living plants on the approved reference area or to the <br />standards in other technical guides approved by the Director for use in <br />the regulatory program. The period of extended responsibility under the <br />performance bond requirements of Subchapter J initiates when ground <br />cover equals the approved standard after the last year of augmented <br />seeding, fertilizing, irrigation or other work which ensures success <br />in-- <br />• (i) Areas of more than 26.0 inches average annual precipitation; and <br />continues for not less than five years. Ground cover and productivity <br />shall equal the approved standard for the last two consecutive years of <br />the responsibility period; or in <br />(ii) Areas of less than or equal to 26.0 inches average annual precipi- <br />tation; and continues for not less than 10 years. Ground cover and pro- <br />ductivity shall equal the approved standard for the last two consecutive <br />years of the responsibility period. <br />(2) For purposes of paragraph (b)(1) of this Section, the average <br />annual precipitation can be determined either-- <br />(i) By interpolation, using standard techniques, from "Mean Annual Pre- <br />cipitations," Map, p. 97, The National Atlas of the United States, U~S~ <br />Department of the Interior, Geological Survey, 1970; or from "Climactic <br />Atlas of the United States," U.S. Dept. of Commerce, National Oceanic <br />• and Atmospheric Administration, 1974; or from long-term precipitation <br />816-158a <br />
