One letter from the DOW dated December 21, <br />1995 addresses several mitigation suggestions, however it does not discuss the woody <br />plant issue. All woody plant density standards or lack thereof, are to be developed in <br />consultation with the DMG and the DOW. Please provide concurrence from the DOW <br />regarding the woody plant stocking level and recommended density, or that they do not <br />feel a density standazd is advisable in this case. <br />Section 2.05.3, Oueration Plan <br />11. In Section 2.05.3(2)(6), please update the mine plan map, Map No. ]4, [o show the aerial <br />extent and timetable of the anticipated mining for this new five year term. <br />12. Exhibit 10 of Volume III contains construction permits that have an initial approval. <br />Please update the Division as to the status of securing final approval for these permits. <br />Section 2.05.4, Reclamation Plan <br />13. BRL has submitted an up to date reclamation liability estimate for the Bowie No. 2 Mine <br />in Pemut Revision No. 6. BRL and the Division have both agreed to this estimate and the <br />estimate can suffice for this permit renewal. <br />Section 2.07.6, Criteria for Review of Permit Applications for Permit Approval or Denial <br />14. As required in Section 2.07.6(1)(6), the Division has conducted a computer check of the <br />Applicant Violator System (AVS). The system recommendation was for a conditional <br />issue. The violations that form the basis of the recommendation have already been <br />covered in Stipulation No. 12. The Division will conduct additional AVS checks before <br />the perrnit renewal is final. <br />Section 2.10, Maps and Plans <br />15. As required in Section 2.10.3(d), please update the appropriate maps to show the current <br />locations and uses of buildings on and within 1000 feet of [he permit area. There has been <br />recent demolishing of some residences and other buildings and the construction of one <br />residence by BRL to the east of the Terror Creek Loadout. <br />
