Cattany <br />Rocky Mountain Materials Division DlnYtOf <br />1910 Rand Avenue Natural Resource Trustee <br />Colorado Springs, Colorado 80906 <br />Re: Sokol Pit M-1980-193 Amendment Application Public <br />Notice. <br />Dear Mr. Smith, <br />On October 21, 2005, the Division of Minerals and Geology <br />(Division) was contacted by David Doran, a citizen of <br />Calhan, who indicated he had not seen a newspaper notice in <br />any of the locally circulated newspapers (which he said <br />were the Gazette Telegraph and the Ranchland News) <br />announcing Rocky Mountain Materials' (RMM) application for <br />amandment of the above-captioned permit. Publication of "a <br />public notice in a newspaper of general circulation in the <br />locality of the proposed mining operation" is a requirement <br />of Rule 1.6.2(1)(d) of the Construction Materials Rules and <br />Regulations. Mr. Doran had contacted the Division also on <br />10/5/OS with the same issue. <br />By the end of the comment period, October 4, 2005, the <br />Division had received 24 timely objections. Around that <br />time, the Division contacted you about Mr. Doran's concern <br />and received your assurance that the newspaper in which the <br />Notice was published was indeed of general circulation in <br />the area and that it was also available in the general <br />store in Calhan, Colorado.
