Minerals and Geology <br />1313 Sherman Street <br />Room 215 <br />Denver, Colorado 80203 <br />Re: Summit Pressed Brick and Tile Company - <br />8-Mile Clay Mine - M-77-320 <br />Dear Mr. Schreiner: <br />TGLEPNONE <br />nu, fao.na <br />PAI <br />I YIf> ife.uu <br />Per our conversation Friday, this letter will explain <br />the reasons Summit requested the 30 day extension to provide <br />corrective action concerning highwalls as referenced in your <br />inspection report on the above mine. <br />Joe Welte, the President of Summit, contacted the <br />consulting geologist used by Summit and two engineers, all of <br />whom felt they did not have the qualifications to provide the <br />stability analysis requested. Mr. Welte then contacted Mr. <br />Bill Boies, formerly the chief mining engineer for Colorado <br />Fuel and Iron, who is now a consulting engineer. Mr. Welte <br />and Mr. Boies made arrangements to qo to the mine and visited <br />the mine on February 24. Mr. Boies examined the site and <br />measured the existing highwall at 35 feet to 38 feet if you <br />include the vegetated slope at the top. On or about February <br />28, Mr. Boies asked for some additional information on the <br />mine and Joe Welte provided that to him around March 1. At <br />that point Mr. Boies indicated he should have his report done <br />that week. Around either March 4 or March 7, Mr. Welte <br />called Mr. Boies and Mr. Boies stated that he had been sick, <br />but that he should have the report completed by the time Mr. <br />Welte returned from an out of town trip (around March 12). <br />On March 17, Mr. Welte again called Mr. Boies and at that <br />point Mr. Boies told Mr. Welte that he felt, after reviewing <br />it, that he did not have the proper equipment and recent <br />experience necessary to do the analysis. <br />• P.2i3 <br />Mr. welte is going to have another meeting with Mr. <br />Boies to determine whether or not Mr. Boles can complete the <br />
