Mr. Welte then contacted Mr.
Bill Boies, formerly the chief mining engineer for Colorado
Fuel and Iron, who is now a consulting engineer. Mr. Welte
and Mr. Boies made arrangements to go to the mine and visited
the mine on February 24. Mr. Boies examined the site and
measured the existing highwall at 35 feet to 38 feet if you
include the vegetated slope at the top. on or about February
28, Mr. Boies asked for some additional information on the
mine and Joe Welte provided that to him around March 1. At
that point Mr. Boies indicated he should have his report done
that week. Around either March 4 or March 7, Mr. Welte
called Mr. Boies and Mr. Boies stated that he had been sick,
but that he should have the report completed by the time Mr.
Welte returned from an out of town trip (around March 12).
On March 17, Mr. Welte again called Mr. Boies and at that
point Mr. Boies told Mr. Welte that he felt, after reviewing
it, that he did not have the proper equipment and recent
experience necessary to do the analysis.
• uw orneee
BRIAN N.
