<br />6) Eastside proposed dropping Tasks 5, 15 and 16 from the <br />bond estimate. The Division noted that removal of these <br />tasks from the bond estimate requires a bond reduction <br />request to be <br />7j Wording placed in the text on page 109 to require <br />approval by the Division prior to removing the sediment <br />pond adequately addresses this concern. <br />8) Eastside's responses to the concerns outlined in Susan <br />Burgmaier's memo, dated February 14, 1995 have been <br />adequately addressed, with the exception that Eastside <br />needs to provide designs for erosion control in the <br />reconstructed channel. <br />9) The Division has reviewed Eastside's request to approve <br />the mine bench material as being a suitable substitute <br />for topsoil. Due to early closure of the mine, the areas <br />from which topsoil was to be salvaged for reclamation of <br />the mine bench were never disturbed. As a result, <br />topsoil anticipated in the reclamation plan for <br />reclamation of the mine bench area is not available <br />without disturbing an undisturbed portion of the permit <br />area. The minimal data available indicates the bench <br />material is probably a suitable topsoil substitute. <br />The Division recommends that Eastside avoid stripping <br />topsoil form undisturbed ground to cover the bench area <br />unless further tests indicate that additional topsoil is <br />required. The mine bench material should be utilized for <br />backfill and grading, and the surface material should be <br />sampled according to the following guidelines: <br />a) A pattern of sampling sites should be selected <br />to ensure that all areas requesting topsoil <br />substitution are represented. Given the size <br />of the bench area, four or five sample <br />locations should suffice; <br />b) At each location, samples should be collected <br />at six-inch depth intervals for a total depth <br />of two feet (4 sub-samples per sample <br />location); and <br />c) Physical and chemical analyses required by <br />Rule 4.06.2(4)(a)(i} should be provided. In <br />addition to the parameters listed in <br />4.06.2(4)(a)(i), analyses for nitrogen content <br />should also be provided. <br />Upon completion of the sampling analyses, Eastside should <br />add amendments as required by Rule 4.06.5, or consider <br />importing topsoil from the refuse area, if necessary. <br />
