6) Eastside proposed dropping Tasks 5, 15 and 16 from the
bond estimate. The Division noted that removal of these
tasks from the bond estimate requires a bond reduction
request to be
7j Wording placed in the text on page 109 to require
approval by the Division prior to removing the sediment
pond adequately addresses this concern.
8) Eastside's responses to the concerns outlined in Susan
Burgmaier's memo, dated February 14, 1995 have been
adequately addressed, with the exception that Eastside
needs to provide designs for erosion control in the
reconstructed channel.
9) The Division has reviewed Eastside's request to approve
the mine bench material as being a suitable substitute
for topsoil. Due to early closure of the mine, the areas
from which topsoil was to be salvaged for reclamation of
the mine bench were never disturbed. As a result,
topsoil anticipated in the reclamation plan for
reclamation of the mine bench area is not available
without disturbing an undisturbed portion of the permit
area. The minimal data available indicates the bench
material is probably a suitable topsoil substitute.
The Division recommends that Eastside avoid stripping
topsoil form undisturbed ground to cover the bench area
unless further tests indicate that additional topsoil is
required. The mine bench material should be utilized for
backfill and grading, and the surface material should be
sampled according to the following guidelines:
a) A pattern of sampling sites should be selected
to ensure that all areas requesting topsoil
substitution are represented. Given the size
of the bench area, four or five sample
locations should suffice;
b) At each location, samples should be collected
at six-inch depth intervals for a total depth
of two feet (4 sub-samples per sample
location); and
c) Physical and chemical analyses required by
Rule 4.06.2(4)(a)(i} should be provided. In
addition to the parameters listed in
4.06.2(4)(a)(i), analyses for nitrogen content
should also be provided.
Upon completion of the sampling analyses, Eastside should
add amendments as required by Rule 4.06.5, or consider
importing topsoil from the refuse area, if necessary.
