Box 535 <br />Somerset CO 81434 <br />RE: Preliminary Adequacy Letter, RN-04 <br />Dear Mr. Kiger: <br />The Division has received your application for permit renewal and called it complete for the <br />purposes of filing. We are currently reviewing the permit and anticipate providing you with some <br />comments concerning updates and changes in the permit. <br />As we've discussed, one key issue for this renewal will be a bond compliance inspection: The <br />Division Will do an on-site inspection of all facilities with the goal of conSrming that the current <br />bond estimate covers what is present at the mine right now, no more, no less. <br />Not long ago, Oxbow Mining LLC forwarded a letter to the Division from Montgomery-Watson- <br />Harza, stating that a number of structures have been bonded for in the permit that do not exist or <br />were never constructed on the site. We would like to request that Oxbow Mining LLC provide a <br />list of those structures that you think are present in the bond, but are not present on the site. <br />Using this, our personnel can better prepare for the on-site inspection. <br />We anticipate conducting this inspection when weather conditions are favorable -probably in <br />May or June of this year. <br />If you have any questions, please call me or Jim Stark at the Division.
