SHELTON, Director March 17, 1987 Gifford Allen Route 2 Hotchkiss, Colorado 81419 Re: Blue Ribbon Coal Company Bond Release Request - File No. C-81-047 Dear Mr, Allen: I just wanted to acknowledge receipt of comments submitted by David Sturges on your behalf. After considering the points raised in the letter we find that our position has not changed since our meeting at the informal conference. The letter made it clearer to us what your concerns are and the regulatory basis for your request. However, we feel the issues raised were related to the permit review process which is separate from our bond release process. As stated previously, since the reclamation (grading and backfilling) is now completed and it was done in accordance with what we approved, we have no basis for denying Blue Ribbon's bond release request. Your letter also requested that vre delay our bond release decision to enable more time to discuss the issues. Our regulations have a 30 day time limitation for making a decision after the informal conference. We can not extend this decision date without concurrence from Blue Ribbon Coal Company. My phone conversation with Jim Stover of Blue Ribbon Coal Company revealed that they did not want the decision delayed. Therefore, we will proceed with our proposed decision.
