Neal Starkebaum,
Land Use Planner
Gunnison County Department of Planning
Gunnison County Courthouse
200 E. Virginia
Gunnison, CO 81230
NOV 12 1999
Division o1 Minerals ri Geology
Re: Response to Concerns Regarding Oxbow Mining, Inc.'s Application for Land
Use Change, Ells Creek Mine Facilities
Dear Mr. Starkebaum:
In response to the concerns that you expressed to me by telephone two weeks ago regarding ,
Gunnison County's proposed land use change approval schedule, State and Federal agencies'
permit approval schedules, and compliance with conditions of the past land use change
approval, Oxbow Mining, Inc. ("OMI") provides the following information.
OMI will be meeting with the Colorado Division of Minerals and Geology ("CDMG") on
Friday, November 12, 1999, to discuss the remaining questions on the Elk Creek 1\tine
facilities construction per Technical Revision 32. A request to extend the proposed decision
date for this application to December 17, 1999 will be submitted to accommodate final
responses. With this approval, the CDMG will have obtained the appropriate State and
Federal agencies' concurrence, including the Division of Wildlife, the Department of Public
Health and Environment ("DPH&E'~, and the Office of Surface Mining.
Attached are copies of the approved Construction (air emissions) Pertnit from the DPH&E
and the Nationwide General Permit 2] approval from the Army Corp of Engineers for the
Elk Creek Mine facilities project. The DPH&E approval of a new CDPS water discharge
point is pending and has apparently been delayed thus far only because of the heavy
workloads of the Water Quality Control Division. Approval is anticipated b}' the Division
some time in January 2000.
OMI has again reviewed its current, approved air permit to ensure that the required controls
and maintenance are being conducted. This review showed that OMI's operations are being
operated within the permitted emissions levels. I have visited with and inspec[ed some areas
of concern with local residents and am working with. them to minimize their perceived
impacts. After the community meeting in Somerset with the Gunnison County Board of
Counry Commissioners this past Monday, Mr. Cazl Nation commented to me that he
3737 Hwy 1 33 PO Box 535 Somerset, ColoraGO a 1434 USA
TEL (970) 929-5122 FAX (970 ) 929-5177
