Box 591 <br />5174 Highway 133 <br />Somerset, CO 81434 <br />(970)929-5015 <br />Faz (970) 929-5595 <br />September 14, 2000 <br />Mr. James Burnell <br />Colorado Division of Minerals and Geology <br />Office of Mined Land Reclamation <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Mouutaiu Coal Company LLC (MCC), West Elk Mine; Permit No. C-80-007; Miuor <br />Revision No. 271, Channel Maintenance and Erosion Control -Main Stem Sylvester Gulch. <br />Dear Mr. Btnnell: <br />As a result of our recent discussions, my telephone discussions with Mr. David Berry of the Division <br />and the Division's inspections, MCC has a need to complete maintenance and install channel erosion <br />control on a 300-700 lineal feet section of the Main Stem of Sylvester Gulch. The minor revision is <br />necessary and prudent to prevent, to the extent possible, additional contributions of suspended solids to <br />the flow in Sylvester Gulch, from a secondary natural channel that has meandered into the alluvial <br />deposits at the East Stem of Sylvester Gulch, and return the flow to the original natural channel of <br />Sylvester Gulch. The location of the channel alignment is shown on the enclosed map. <br />Channel maintenance and erosion control consists of clearing the original channel of brush and debris <br />that caused the flow to meander to the secondary channel, and to install large size pit-run gravel (+4 - <br />inch) for the floor of the channel. The project will require a track mounted excavator to clear the debris <br />and prepaze the channel (a width of approximately 12 feet) for pit-run gravel placement. We believe <br />that the majority of the work can be completed by the track mounted excavator operating from the East <br />Fork Road. As shown on map, the area is not chazacterized by a wetland and minimal disturbance is <br />anticipated by the maintenance activity. It is anticipated that the project will take 5 days to complete. <br />Mobilization of equipment would begin September 15, 2000, and MCC would begin the work on <br />September 18, 2000, and could complete it September 22, 2000. The area will then be fertilized, <br />seeded, and mulched, on completion of the maintenance and erosion control project. <br />The Division's prompt action on approving this project is appreciated as MCC is prepazed to <br />commence work on September 15, 2000. <br />
