The revision was submitted
by The Pittsburg & Midway Coal Mining Co.. All review and comment periods as provided in the Act and the
Regulations initiate from this date of filing.
The revision revises the permit boundary. The area of the permit is reduced by withdrawing some 171.2 acres of
unaffected private land about the perimeter of the permitted area.
The Surface coal mining operation is on land located approximately 5 miles Northwest of Oak Creek, Colorado.
The permit area is further described as follows:
TSN, R85 W, Portions of Sections 31, 32
TSN, R86W, Aortions of Section 36
T4N, R86W, Portions of Sections 12, 13, 14, 23, 24, 25
T4N, R85 W, Portions of Sections 7, 8, 17, 18, 19, 29, 30
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek, Oak Creek,
and Rattlesnake, Colorado.
The above referenced technical revision application would not incorporate additional lands into the permit area or
otherwise alter, except for a reduction in the permit area, previously approved permit conditions or mitigation
measures. However, we are requesting your agency's evaluation of the proposal. Your comments and concerns
relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclamation
plan as it relates to fish and wildlife considerations, including potential impacts to threatened or endangered
species, are requested.
