Canany <br />Division Director <br />Na[urzl Resource Trustee <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on August 16, 2005, an application to revise coal mining <br />operations at the Edna Strip Mine was considered complete for the purposes of filing. The revision was submitted <br />by The Pittsburg & Midway Coal Mining Co.. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />The revision revises the permit boundary. The area of the permit is reduced by withdrawing some 171.2 acres of <br />unaffected private land about the perimeter of the permitted area. <br />The Surface coal mining operation is on land located approximately 5 miles Northwest of Oak Creek, Colorado. <br />The permit area is further described as follows: <br />TSN, R85 W, Portions of Sections 31, 32 <br />TSN, R86W, Portions of Section 36 <br />T4N, R86W, Portions of Sections 12, 13, 14, 23, 24, 25 <br />T4N, R85 W, Portions of Sections 7, 8, 17, 18, 19, 29, 30 <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek, Oak Creek, <br />and Rattlesnake, Colorado. <br />The above-referenced technical revision application would not incorporate additional lands into the permit area, <br />but reduces the permit area by withdrawal of unaffected land. Other than the reduction, the proposed technical <br />revision does not alter previously approved permit conditions or mitigation measures. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have <br />your concurrence in order to approve this proposal. We are required to make a finding that "the proposed <br />operations will not adversely affect any publicly owned park or place listed on or those places eligible for listing, <br />as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and <br />Office of Office of Colorado <br />Mined land Reclamation Active and Inactive Mines Geological Survey <br />
