L.P., (C-81-019) <br />Technical Revision No. 44 <br />Additional Information, Response to Technical Adequacy 2 <br />Dear Mr. Walker: <br />Attached please find information addressing modifications to our TR~4 submittal. The submittal of <br />this information is a result of our review of the Divisions Technical Adequacy 2 letter of April 13, <br />1998. <br />Item 1 -Notification of residences or owners of dwellings or structures located within one-half mile of <br />the area affected by blasting activities. <br />While the cited Statute does require specific notifications there is, however, no requirement for a <br />map as suggested by the Division. However, to address other Division concerns we have modified <br />the Map 26 -Blasting Pattern Alterations -Overburden and deleted Maur 27 -Blasting Pattern <br />Alterations -Coal from the Permit. The information contained in the revised Map 26 (now referred to <br />as "Blasting Analysis Map") and the modified Permit section 4.08.3 will address the issue of <br />notification of blasting within one-half mile of a residence. In general, this required notification <br />procedure will not occur at Colowyo for a couple more years due to the schedule of our mining <br />advances. When the time occurs for this requirement to be implemented, if no variance is provided <br />by applicable residents, Colowyo's procedure will be to contact the occupants of a residence no <br />less than 24 hours prior to an applicable blast and documentation of the notification will occur on the <br />specific blast report. <br />At this time the only applicable residence is the Durham residence which is shown on the revised <br />Map 26. <br />The Division should also be aware that Rule 4.08.4(8) is inconsistent with the applicable Statute. <br />While the Statute requires daily notifications (assuming this means 24 hours or less), the Rule <br />states that notifications are to occur "no less than 24 hours prior' to the blast. Thus, the two <br />statements appear to be in conflict. Please advise! <br />Item 2 -Rule 4.08.1(41(b) Blast Design <br />General Comments: <br />The Division states that the Colowyo Permit is apparently deficient because certain elements of <br />Rule 4.08.1(4)(b) are not addressed. Colowyo's interpretation of this specific Rule is that submittal <br />
