The entire, permitted mine site, <br />plus an access road to the original mitring area, which is covered by 110 Limited Impact Permit No. M- <br />2002-113 are shown on the attached dmwing. <br />The acreage added to the mine site by the amendment of March 28, 20021ies immediately west of the <br />Fulton Ditch and immediately north of 120i6 Avenue. As part of the amendment the DMG approved an <br />access point onto 120th Avenue in the extreme southwest corner of the new acreage, also shown by the <br />attached drawing. <br />On June 2, 2003 the Adams County Board of Commissioners approved Conditional Use Permit No. <br />EXG2002-00004 to allow mining on the new acreage (west of the Fulton Ditch) of the 124'" Estates Sand <br />and Gmvel Mine. In its review process, the County wanted all mine traffic to access IZOs' Avenue as <br />closely as possible to Hwy 85, and in fact, would not approve the access point that was approved by the <br />DMG. The County wanted mine traffic from the new acreage to access 120th Avenue using the hauUaccess <br />road, which is covered by the Limited Impact Permit. The 124's Estates Partners is therefore seeking a <br />Technical Revision to Permit No. M-2001-085 [o allow access onto 120`6 Avenue from its land on the west <br />side of the Fulton Ditch via the access/haul road, which is covered by 110 Limited Impact Permit No. M- <br />2002-113. The 124`" Estates Partners intend to use this hauVaccess road in the manner described above <br />only through the 2003 construction season. Before the 2004 season, [he 12416 Estates Partners will seek to <br />amend Permit No. M-2001-085 to include a different crossing of the Fulton Ditch, while using a portion of <br />the access/haul road currently covered by the Limited Impact Permit and the same access point onto 120th <br />Avenue. <br />Please call me at 303-808-6359 or Les Ewegen at 303-067-1666, if you have questions or need additional <br />information.
