<br />The Review Process (PR-5)

<br />On May 10, 2005, Seneca Coal Company submitted an application for Permit Revision No.
<br />5 (PR-5) for mining and reclamation activities at the Seneca II-W Mine. The application
<br />was deemed complete for purposes of filing on May 16, 2005, and wmpleteness
<br />notifications were sent to Routt County Commissioners, Routt County Planning
<br />Department, OSM, BLM Little Snake Field Office, Water Quality Control Division, State
<br />Land Board, NRCS Steamboat Springs Field Office, Air Pollution Control Division,
<br />Colorado Geological Survey, Colorado Division of Wildlife, State Historic Preservation
<br />Office, U.S Fish and Wildlife Service, and permit area landowner Theresa Friederich. A
<br />public notice of the application was published in the Steamboat Pilot once a week for four
<br />consecutive weeks beginning May 29, 2005 and ending June 19, 2005.
<br />Two comment letters were received during the review. The State Historic Preservation
<br />Officer (SHPO) commented in a letter of June 2, 2005 that, because the revision would not
<br />result in additional land disturbance, there would be no effect to historic properties.
<br />BLM Little Snake Field Office (LSFO) noted in a letter of August 10, 2005, that SCC
<br />would need to modify their Resource Recovery and Protection Plan (RZP2) to address the
<br />proposed mine plan changes and modified reserve tonnages.
<br />The Division issued two preliminary adequacy review letters addressing different issues,
<br />the first on July 11, 2005 and the second on August 25, 2005. The BLM/LSFO letter was
<br />forwarded to the operator as an attachment to the second letter. The letters requested
<br />various clarifications and amendments with respect to operational plans, disturbed area
<br />delineations, slope stability demonstration, topsoil removal and distribution plans, drainage
<br />channel and stock pond designs, weed control plans, and shrub establishment area details.
<br />The Division forwarded the results of a preliminary cost estimate review to SCC in a letter
<br />of September 6, 2005. The review determined that the cost estimate previously conducted
<br />in association with Permit Renewal No. 4 (RNA), was also applicable to PR-5. RN-4
