•- /.~
Stormwater Permit Requirements for Mining Activities
Jttne 22, 1995
Page 2
Permit Requirements
The major permit requirement is implementation of a SWMP. The objective of the SWMP is to
identify sources of stotmwater pollution and then implement Best Management Practices to control
those sources. If a discharge of stormwater leaves the site without implementation of a SWMP or
without the acquisition of a stormwater discharge permit, it is a violation of the Colorado Water
Quality Control Act and is subject to enfotrement action by the Water Quality Control Division. The
Colorado Water Quality Control Ac[ authorizes both civil and criminal penalties for willful non-
compliance.
Potential Exemptions
If a stotmwater permit is not applicable [o this operation, please send us a letter detailing the basis for
this, by the above deadline. Two potential exemptions are available. If all runoff from the mine site
is contained on the site, with no discharge off site, a stotmwater permit is not required. Bond release
firom the site's MLRB reclamation permit is another acceptable basis for exemption.
If there ate any questions regarding the stotmwater program, please give me a call at (303) 692-3606.
Sincerely,
~'l'
Daniel M.
