Long <br />Division Director <br />Pursuant to Title 34, Article 35, Paragraph 3, of the Colorado Revised <br />Statutes, the Division of Minerals and Geology hereby issues notice that on <br />November 15, 1993, an application to revise a permit to conduct coal mining <br />operations at the King Coal Mine, File No. C-81-035 (PR-04), by National King <br />Coal, 4424 County Road 120, Hesperus, Colorado 81326, was deemed complete for <br />the purposes of filing. All reviews and comment periods as provided in the <br />Act and Regulations promulgated thereunder initiate from this day of filing. <br />The applicant proposes to add 240 acres to the permit area and to revise <br />numerous permit application pages. <br />The King Coal Mine is located seven miles southwest of Hesperus, Colorado, in <br />portions of Sections 31 and 32, Township 35 North, Range 1 West of the <br />N.M.P.M. These tracts of land are shown on USGS 7.5 minute Quadrangle maps of <br />Kline and Hesperus. <br />Because the above referenced permit revision application would incorporate <br />additional lands into the permit area or might otherwise alter previously <br />approved permit conditions or mitigation measures, we are requesting your <br />agency's evaluation of the proposal. Your comments and concerns relating to <br />the adequacy of fish and wildlife resources information, the fish and wildlife <br />plan, and the reclamation plan as it relates to fish and wildlife <br />considerations, including potential impacts to threatened or endangered <br />species, are requested. If wildlife habitat is the proposed postmining land <br />use, we request your evaluation of proposed woody plant stocking levels, <br />planting arrangements, and methods for mitigation of potential adverse impacts. <br />A copy of the permit revision is enclosed. In order for us to comply with <br />regulatory time frames, we request that comments be submitted to the Division <br />of Minerals and Geology at the above address by 5:00 p.m. on December 24, 1993. <br />If no comments are received by this date, we will proceed on the assumption that <br />your agency has no concerns with or objections to the applicant's proposal. <br />A copy of the permit revision application is available for public inspection <br />at the La Plata County Courthouse, 1060 East Second Avenue, Durango, <br />Colorado.
