3
When the Division issues a proposed decision on BRL's permit revisions, copies
of that decision will be provided to all persons who commented on or objected to
the application. Notice of the proposed decision will also be published in the
Delta County Independent once a week for two consecutive weeks. If you
object to the Division's proposed decision, you may request a hearing before the
Colorado Mined Land Reclamation Board. The regulatory provision for such a
hearing reads,
"Any person with an interest which may be adversely affected by the
proposed decision may request a formal hearing before the Board on the
proposed decision. Such request must be made within 30 days of the first
publication of the proposed decision of the Division, be in writing, and
state with reasonable specificity the reasons for the request and the
objections to the proposed decision." (This is Rule 2.07.4(3)(a) of the
Regulations of the Colorado Mined Land Reclamation Board for Coal
Mining.)
I hope the information above clarifies the status of the issues you identified in
your letter. Thank you for interest and participation in this permitting process.
If you have questions, feel free to contact me.
Sincerely,
Larry Routten
Senior Environmental Protection Specialist
cc: Joe Dudash
Jim Stover (Stover and Associates)
Bill Bear (Bowie Resources Ltd.)
Bowie2P F2i nfconf _Higman
